These Terms and Conditions ("Terms") govern your use of the CannaQuest platform operated by CannaQuest Pty Ltd (ABN XX XXX XXX XXX) ("we", "us", "our"). By accessing or using our platform, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years of age and an Australian resident to use our services. You must provide accurate and complete information when creating an account.
2. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use.
3. Medical Services
Our platform facilitates access to medical consultations and prescriptions for medicinal cannabis. All medical decisions are made by qualified, registered prescribers. We do not provide medical advice directly.
4. Prescriptions and Orders
Prescriptions are issued at the sole discretion of the prescriber. Not all consultations will result in a prescription. Orders are fulfilled by licensed pharmacists and are subject to product availability and regulatory requirements.
5. Payments and Refunds
All payments are processed securely through Stripe. Consultation fees are non-refundable once the consultation has taken place. Product refunds are handled in accordance with Australian Consumer Law.
6. Prohibited Conduct
You must not use the platform for any unlawful purpose, provide false or misleading information, attempt to obtain prescriptions through deception, share your account with others, or interfere with the platform's operation.
7. Intellectual Property
All content on the platform, including text, graphics, logos, and software, is the property of CannaQuest Pty Ltd or its licensors and is protected by Australian intellectual property laws.
8. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability is limited to the amount you have paid us in the preceding 12 months.
9. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
10. Changes to These Terms
We reserve the right to modify these Terms at any time. Continued use of the platform after changes constitutes acceptance of the updated Terms.
